(Criminal / Evidence / Hearsay)

In the weeks leading up to his death, the victim of a murder made statements to his mother indicating that the accused may have had a motive to kill him. The Court held that the statements were properly admitted under the principled approach to hearsay as the Crown had established the twin criteria of necessity and reliability on a balance of probabilities.
