K was employed for 11 years with Honda before being diagnosed with chronic fatigue syndrome.  After a period in the company's disability program, Honda asked K to consent to a review by an occupational medical specialist.  K refused, and was ultimately terminated.  K sued for wrongful dismissal, and was awarded aggravated and punitive damages, and increased costs.  The Court allowed the appeal, setting aside the aggravated and punitive damages, and reducing the costs award to regular costs.
