A Quebec real estate broker required vendors to pay a non-refundable fee when they signed an exclusive brokerage agreement. Two vendors challenged this fee, arguing that since it applied regardless of whether a sale closed or not, it violated the Association's rules. The Court upheld the decision of the Association's discipline committee, which found that the fee violated the Association's rules.
