Z was sexually assaulted by a prison official while imprisoned. After his release, he became addicted to heroin and a repeat offender. A psychologist testified that the assaults caused Z to start using heroin and exacerbated his criminal behaviour. The Supreme Court held that Z is not entitled to lost wage compensation for periods of incarceration, and that future wages could be discounted for an increased risk of recidivism.
