S. was convicted of second degree murder, based in part on evidence that he gave to the police over a series of interviews. S. had spoken with a lawyer, and repeatedly stated that he did not want to talk to the police about the incident. The Court upheld the conviction, finding that S.'s statement to the police was voluntary, and therefore there was no infringement of his s. 7 Charter right.
