Hoping no one was home, four intruders broke into a house hoping to find a marijuana grow operation. Two residents were in the house and heard the four intruders repeatedly referring to a gun that one of them had. The Court ruled that all four intruders “used” the gun, which was in their physical possession or readily at hand, in order to facilitate the commission of the indictable offence of break and enter.
