The Health and Social Services Delivery Improvement Act, S.B.C. 2002, c. 2 was passed by the British Columbia legislature without much consideration of the impact it would have on the contractual and collective bargaining rights of the unions it affected.  The appellant unions challenged the constitutional validity of Part 2 of the Act as violative of the guarantees of freedom of association and equality protected by the Charter.  The court found certain sections of the Act to be unconstitutional, but suspended the declaration of invalidity for a period of 12 months.
